California Supreme Court Grants Review on Retroactivity of FEHA Amendment Imposing Employer Liability for Sexual Harassment by Non Employees As we expected, the California Supreme Court has granted review in Carter v. California Department of Veterans Affairs, a case that addresses the issue of whether the recent FEHA amendment imposing liability on employers for sexual harassment by nonemployees can be retroactively applied. We last reported on this case in August, 2004. We will continue to keep you updated.
